California Divorce Overview

California is a 'no-fault' divorce state, which means that when a spouse requests a divorce, they will not need to specify a reason or prove wrong-doing on part of the other. From time of initial filing, the soonest a divorce can be finalized is 6 months.

"Clueless" star Stacey Dash was granted a restraining order against her husband on the day she filed for divorce - after alleging he was physically abusive during their two-year union.

The 44-year-old actress split from her husband of three years, Emmanuel Xuereb, in January and a judge granted her a protection order when she filed legal papers to make the split official.

The order, signed by a judge on January 29, has been obtained by TMZ.com and the documents include Dash's allegations that her partner hit her in the face, head and body during their marriage.

In the papers, Dash describes one terrifying ordeal in which Xuereb allegedly pinned her down to a bed and threatened her.

The actress, who is now romantically linked to Oscar-winner Jamie Foxx, claims she was too scared to report her allegations to police at the time.

Xuereb is ordered to stay 100 yards away from Dash, her two children from previous relationships, and the family home. The former couple is due back in court in June.
